| DECISION & ORDER ON MOTION |
Motion by the appellant for leave to serve and file a supplemental the record on an appeal from an order and judgment (one paper) of the Supreme Court, Kings County, dated April 15, 2015, to include the transcript of an administrative hearing which occurred on February 21, 2014, annexed to the appellant's motion papers, and/or the "tape (CD-ROM)" of that hearing.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the matter is remitted to the Supreme Court, Kings County, to report on whether the Court considered the transcript of the administrative hearing which occurred on February 21, 2014, annexed to the appellant's motion papers, and/or the "tape (CD-ROM)" of that hearing, in determining the motion and the petition that resulted in the order and judgment dated April 15, 2015, and the appellant's motion for leave to serve and file a supplemental record is held in abeyance in the interim. The Supreme Court, Kings County, shall file its report with all convenient speed.
