Motion by the respondent to dismiss an appeal from a judgment of the County Court, Suffolk County, rendered March 27, 2009, for failure to timely perfect.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied with leave to renew after May 31, 2016, if the appellant fails to move for poor person relief and the assignment of counsel, or advise the Court, in writing, of the name and address of retained counsel.
