Respondent having moved for an extension of time to file and serve a brief on this CPLR article 78 proceeding transferred to this Court by an order of the Supreme Court entered in the Office of the Clerk of the County of Cayuga on October 26, 2015,
Now, upon reading and filing the affirmation of Marcus J. Mastracco, Esq., dated March 23, 2016, and the notice of motion with proof of service thereof, and due deliberation having been had thereon,
It is hereby ORDERED that the motion is granted to the extent that the second ordering paragraph of the order of this Court entered December 31, 2015, is hereby amended by deleting the date March 23, 2016, and inserting in its place the date April 22, 2016, and
It is further ORDERED that the proceeding is removed from the day calendar for May 16, 2016, and shall be added to the calendar for the term of this Court commencing June 20, 2016.
