On the Court's own motion, it is
ORDERED that the decision and order on motion of this Court dated April 1, 2016, in the above-entitled case is recalled and vacated, and the following decision and order on motion is substituted therefor:
Motion by counsel assigned to represent the defendant in the Supreme Court, Kings County, to be relieved of the assignment to respond to an appeal by the People from an order of that court, dated October 23, 2015.
Upon the papers filed in support of the motion and the papers filed in relation thereto, it is
ORDERED that the motion is granted; and it is further,
ORDERED that counsel is directed to turn over all papers in the action to new counsel herein assigned; and it is further,
ORDERED that Lynn W. L. Fahey, Esq., Appellate Advocates, 111 John Street, 9th Floor, New York, New York 10038, is assigned as attorney for the defendant pursuant to County Law § 722 to respond to the appeal from said order; and it is further,
ORDERED that the respondent is directed to serve one copy of his brief and to file nine copies thereof.
