DECISION & ORDER ON MOTION

2016-488 N C
Elliot Rindenow, Respondent, v Esther Alenick and Hillel Alenick, Appellants.

Appeals from orders of the District Court of Nassau County, First District, entered April 24, 2014 and September 8, 2015, respectively. The order entered April 24, 2014 denied appellants' motion, in effect, for leave to reargue their opposition to respondent's prior motion to strike their jury demand. The order entered September 8, 2015, insofar as appealed from, denied appellants' motion to dismiss the petition. By order of the same court dated January 5, 2016, made upon reargument of appellants' motion to dismiss the petition, appellants' motion to dismiss the petition was granted.

On the court's own motion, it is

ORDERED that the appeals are dismissed.

The appeal from the order entered April 24, 2014 is dismissed on the ground that no appeal lies from an order denying reargument. The appeal from the order entered September 8, 2015 is dismissed in light of the determination made in the order dated January 5, 2016.
