The People, etc., respondent,

v Kim Vasquez, appellant.

(Ind. No. 14-00213)

ORDER TO SHOW CAUSE

Appeal by Kim Vasquez from a judgment of the County Court, Rockland County, rendered June 23, 2015. By decision and order on motion of this Court dated January 8, 2016, the appellant's motion for poor person relief and the assignment of counsel was denied with leave to renew on order before February 29, 2016. The appellant has not renewed the motion.

Now, on the Court's own motion, it is

ORDERED that the appellant is directed to show cause before this Court why an order should or should not be made and entered dismissing the appeal on the ground that the notice of appeal from the judgment was untimely (see CPL 460.30), by filing an affirmation or an affidavit on that issue in the office of the Clerk of this Court on or before May 9, 2016, or by making a motion pursuant to CPL 460.30 for an extension of time to take the appeal; and it is further,

ORDERED that the Clerk of this Court or her designee is directed to serve a copy of this order to show cause upon the appellant at the appellant's last known place of residence or, if the appellant is imprisoned, at the institution in which the appellant is confined, upon the attorney who last appeared for the appellant, and upon the District Attorney, by ordinary mail pursuant to CPL 470.60(2).

DILLON, J.P., AUSTIN, MILLER and LASALLE, JJ., concur.
