Motion by respondent on an appeal from an order of the Civil Court of the City of New York, Kings County, entered October 6, 2015, to vacate a stay granted by decision and order on motion of this court dated December 23, 2015, for the release of funds on deposit, and for other relief.
Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is
ORDERED that the branch of the motion seeking to vacate the stay granted by decision and order on motion of this court dated December 23, 2015 is granted and the stay is vacated; and it is further,
ORDERED that the branch of the motion seeking the release of funds on deposit is granted and the funds on deposit in this matter are directed to be released to respondent 1625 Rockaway Parkway, LLC, less any lawful fees; and it is further,
ORDERED that the motion is otherwise denied.
