DECISION AND ORDER ON MOTION

Motion by the petitioner for leave to reargue a proceeding pursuant to CPLR article 78 in the nature of mandamus, inter alia, to compel the respondent, a Judge of the County Court, Nassau County, to hear and decide the petitioner's motion to recuse the respondent from presiding over a criminal action entitled People v Grafton, commenced under Indictment No. 1332N-2014, which was determined by decision, order and judgment of this Court dated January 13, 2016.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is denied.
