DECISION & ORDER ON MOTION

Motion by the respondent to strike the joint record and the appellants' briefs on appeals from a judgment of the Supreme Court, Westchester County, entered June 13, 2014, and an order of the same court dated April 1, 2015, and to enlarge the time to serve and file a brief.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is to strike the joint record is granted to the extent that pages R.1502 through R.1508, R.1533 through R.1623, and R.1734 of volume 3 of the joint record are stricken, and on or before May 16, 2016, the appellants shall either remove the stricken material from the copies of the joint record filed with the Clerk of this Court or serve and file a replacement volume 3 that does not contain the stricken material; and it is further,

ORDERED that the branch of the motion which is to strike the appellants' briefs is granted to the extent that on or before May 16, 2016, the appellant Bryan Orser shall either remove the last full paragraph on page 25, beginning with "on June 10," and ending with "(JR.1507)." from the copies of his brief filed with the Clerk of this Court or serve and file a replacement brief that does not contain that material; and it is further,

ORDERED that the branch of the motion which is to enlarge the respondent's time to serve and file a brief is granted to the extent that the respondent's time to serve and file a brief is enlarged until June 15, 2016, and the respondent's brief must be served and filed on or before that date; and it is further,

ORDERED that the motion is otherwise denied.
