It is ordered that defendant-appellant's motion is granted to the extent of dismissing the appeal because of appellant's death on February 14, 2013, and remanding the matter to the Criminal Court, New York County, for proceedings to vacate the judgment of conviction ad to dismiss the accusatory instrument.
