DECISION & ORDER ON MOTION

Motion by the respondent 2701 Associates, LLC, to dismiss an appeal from an order of the Supreme Court, Nassau County, dated October 22, 2014, on the ground that the record on appeal is inadequate, or, in the alternative, to enlarge the time to serve and file a brief.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is to dismiss the appeal is denied on condition that on or before June 1, 2016, the appellant serve and file a supplemental record containing any motion papers and the exhibits annexed to the motion papers that were considered by the Supreme Court, Nassau County, in determining the motions that resulted in the order dated October 22, 2014, and that were not contained in the record that was filed on February 22, 2016; and it is further,

ORDERED that the branch of the motion which is to enlarge the time of the respondent 2701 Associates, LLC, to serve and file a brief is granted, the time of the respondent 2701 Associates, LLC, to serve and file a brief is enlarged until July 1, 2016, and that respondent's brief must be served and filed on or before that date.
