DECISION & ORDER ON MOTION

Motion by the respondent to enlarge the time to serve and file a brief on an appeal from an order of the Supreme Court, Queens County, dated February 25, 2015, and for leave to file a supplemental record containing certain documents.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that on the Court's own motion, Volume II of the record is stricken and on or before June 3, 2016, the appellant shall serve and file a replacement Volume II which contains only the motion papers filed with the Supreme Court, Queens County, that resulted in the order dated February 25, 2015, and correct the table of contents in the copies of Volume I filed with the Clerk of this Court; and it is further,

ORDERED that the branch of the motion which is to enlarge the respondent's time to serve and file a brief is granted, the respondent's time to serve and file a brief is enlarged until July 5, 2016, and the respondent's brief must be served and filed on or before that date; and it is further,

ORDERED that the branch of the motion which is for leave to file a supplemental record is denied as academic.
