DECISION & ORDER ON MOTION

Motion by appellant on an appeal from an order of the Justice Court of the Town of East Hampton, Suffolk County, entered July 2, 2015, to continue a stay granted by decision and order on motion of this court dated September 22, 2015, and extended by decision and order on motion of this court dated February 23, 2016, and to compel the Justice Court to file the record on appeal with this court.
Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is
ORDERED that the branch of the motion seeking to continue the stay is granted on condition that appellant perfect the appeal by June 3, 2016 and continue to comply with the other conditions contained in the decision and order on motion of this court dated September 22, 2015; and it is further,
ORDERED that in the event that any of the above conditions are not met, the court, on its own motion, may vacate the stay, or respondent may move to vacate the stay on three days' notice; and it is further,
ORDERED that the branch of the motion seeking to compel the Justice Court to file the record on appeal with this court is denied as academic, as the record has been received by this court.
