| DECISION & ORDER ON MOTION |
Motion by the appellant to stay enforcement of an order of the Supreme Court, Kings County, dated February 25, 2016, as well all proceedings in a certain matter pending in the Civil Court of the City of New York, Kings County, pending hearing and determination of an appeal therefrom.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion is granted to the extent that all proceedings in the matter entitled Boyanzhu v Zaslavskaya, pending in the Civil Court of the City of New York, Kings County, under Index No. L & T 57253/13, are stayed and the respondent is stayed from interfering with the appellant's occupancy in the premises located at 525 Neptune Avenue, Apt 11-A, Brooklyn, NY, on condition that the appeal is perfected on or before June 13, 2016, and the motion is otherwise denied; and it is further,
ORDERED that in the event the appeal is not perfected on or before June 13, 2016, the Court, on its own motion, may vacate the stay, without further notice, or the respondent may move to vacate the stay, on three days notice; and it is further,
ORDERED that on the Court's own motion, the respondent shall serve and file a brief, if any, on or before July 13, 2016; and it is further,
ORDERED that on the Court's own motion, the appellant shall serve and file a reply brief, if any, on or before July 28, 2016; and it is further,
ORDERED that on the Court's own motion, the appeal is granted a preference and will be calendared expeditiously after all of the briefs have been filed.
