| DECISION & ORDER ON MOTION |
Motion by the defendant on an appeal from a judgment of the County Court, Westchester County, rendered February 25, 2014, to withdraw the appeal based upon a decision and order of the County Court, Westchester County, entered July 16, 2015, made upon remittitur from this Court. By decision and order on motion of this Court dated January 6, 2106, inter alia, the decision and order of the County Court, Westchester County, entered July 16, 2015, was vacated, and the defendant's motion to withdraw his appeal was held in abeyance pending receipt of a report from the County Court upon a second remittitur. The County Court has filed its report.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, and upon the report of the County Court, Westchester County, it is
ORDERED that the motion to withdraw the appeal is denied.
