In the Matter of M. W. Antony Smithie,

appellant, v Kristin C. Johnson, respondent.

(Docket No. F-3373-14/14D)

DECISION & ORDER ON MOTION

Appeal by M. W. Antony Smithie from an order of the Family Court, Nassau County, dated August 17, 2015. By scheduling order of this Court dated March 22, 2016, the appellant's time to perfect the appeal was enlarged until April 22, 2016. The appellant has failed to perfect the appeal.

Now, on the Court's own motion, it is

ORDERED that the appeal is dismissed, without costs or disbursements, for failure to timely perfect in accordance with the rules (see 22 NYCRR 670.4[a][2],[4]) and prior order of the Court.
