Appellant having moved for an extension of time to file and serve an addendum to his pro se supplemental brief for the appeal taken from that part of an order of the Supreme Court, Erie County, entered November 26, 2012, which denied his request for forensic DNA testing of evidence, pursuant to CPL 440.30 (1-a),
Now upon reading and filing the statement of Salvatore Letizia dated April 14, 2016, the notice of motion with proof of service thereof, and due deliberation having been had thereon,
It is hereby ORDERED that the motion is granted to the extent that appellant shall file 10 copies of a pro se addendum, with proof of service of one copy on assigned counsel and the People pursuant to 22 NYCRR 1000.3 (f), on or before June 6, 2016, and
It is further ORDERED that respondent shall file a brief in response to the pro se addendum, if any, on or before June 21, 2016.
