Motion by the respondent, inter alia, to vacate a decision and order of this Court dated December 16, 2015, which determined an appeal from a judgment of the Supreme Court, Kings County, dated June 12, 2013. Separate motion by the respondent for leave to appeal to the Court of Appeals from a decision and order on motion of this Court dated December 16, 2015, which denied the respondent's motion to dismiss the appeal.
Upon the papers filed in support of the motions and the papers filed in opposition thereto, it is
ORDERED that the motions are denied.
