Motion by the petitioner-appellant, inter alia, to revoke the letters of administration issued to Richard Burkheit, the Public Administrator of Kings County, on an appeal from a decision of the Surrogate's Court, Kings County, dated February 1, 2016.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that on the Court's own motion, the notice of appeal from the decision is deemed to be a notice of appeal from a decree of the Surrogate's Court, Kings County, dated February 1, 2016 (see CPLR 5512[a]); and it is further,
ORDERED that the motion is denied.
