Appellant having moved to consolidate the appeal taken herein from an order of the Supreme Court entered in the Office of the Clerk of the County of Erie on May 5, 2016 (appeal No. 3), with the consolidated appeals taken from orders of the same court entered March 25, 2015 (appeal No. 1), and May 11, 2015 (appeal No. 2), and having moved for an extension of time to perfect appeals Nos. 1 and 2,
Now, upon reading and filing the affidavit of John T. Loss, Esq., sworn to May 18, 2016, the notice of motion with proof of service thereof, and the affirmation of Jeremy C. Toth, Esq., dated May 25, 2016, and due deliberation having been had thereon,
It is hereby ORDERED that the motion insofar as it seeks to consolidate the appeals is granted, and the appeals from the orders entered March 25, 2015, May 11, 2015, and May 5, 2016 are hereby consolidated for the purposes of perfecting and arguing the appeals, and
It is further ORDERED that the motion insofar as it seeks an extension of time to perfect appeal Nos. 1 and 2 is granted, to the extent that the ordering paragraphs of the order of this Court entered March 21, 2016, are hereby amended by deleting the date May 18, 2016, and inserting in its place the date July 19, 2016.
Memorandum: No further extensions of time to perfect appeal No. 1 will be granted.
