| DECISION & ORDER ON MOTION |
Motion by Adam Lieberman for leave to appeal to this Court from an order of the Supreme Court, Kings County, dated March 1, 2016, and, inter alia, to stay enforcement of the order, pending hearing and determination of the appeal. Application by Hannah Lieberman for poor person relief and for the assignment of counsel.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, and upon the papers filed in support of the application and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the branch of the motion which is for leave to appeal is denied as unnecessary as the order is appealable as of right (see CPLR 5701); and it is further,
ORDERED that the motion is otherwise denied; and it is further,
ORDERED that the application is dismissed without prejudice to making a motion for the relief sought.
