| DECISION & ORDER ON MOTION |
Motion by Richard T. Harris for leave to reargue a disciplinary proceeding against him, which was determined by an opinion and order of this Court dated February 17, 2016, and upon reargument, inter alia, to modify the sanction imposed, or, in the alternative, for leave to appeal to the Court of Appeals from the opinion and order of this Court. Separate motion by Richard T. Harris to stay enforcement of so much of the opinion and order dated February 17, 2016, as suspended him from the practice of law, pending determination of the motion, inter alia, for leave to reargue. Mr. Harris was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the Second Judicial Department on January 18, 1995. By decision and order on application of this Court dated November 20, 2013, the Grievance Committee for the Second, Eleventh, and Thirteenth Judicial Districts was authorized to institute and prosecute a disciplinary proceeding against Mr. Harris based upon the acts of professional misconduct set forth in a verified petition dated June 11, 2013, and the matter was referred to John P. Clarke, as Special Referee, to hear and report. By opinion and order of this Court dated February 17, 2016, Mr. Harris was suspended from the practice of law for a period of three years, effective March 18, 2016, based on five charges of professional misconduct.
Upon the papers filed in support of the motion for leave to reargue or for leave to appeal to the Court of Appeals and the papers filed in relation thereto, and upon the papers filed in support of the motion to stay enforcement of so much of the opinion and order as suspended Richard T. Harris from the practice of law and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion for leave to reargue or for leave to appeal to the Court of Appeals is denied; and it is further,
ORDERED that the motion to stay enforcement of so much of the opinion and order as suspended Richard T. Harris from the practice of law is denied as academic.
