DECISION & ORDER ON MOTION

Motion by the respondent on an appeal from an order of the Supreme Court, Kings County, dated May 28, 2015, to strike the record and the appellant's brief as inadequate and to enlarge its time to serve and file a brief.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is granted; and it is further

ORDERED that on or before August 1, 2016, the appellant shall serve and file a replacement record and brief that complies with the rules of this Court (see 22 NYCRR 670.10.2, 670.10.3); and it is further

ORDERED that the respondent's time to serve and file a brief is enlarged until August 31, 2016, and the respondent's brief must be served and filed on or before that date.
