| DECISION & ORDER ON MOTION |
Motion by the appellant to enlarge the record on appeals from three orders of the Supreme Court, Queens County, two dated June 19, 2015, and one dated November 30, 2015, to include a certain document dated March 16, 2016. Separate motion by the respondent to dismiss the appeals from the orders dated June 19, 2015, as untimely taken or to dismiss all of the appeals on the ground that the record is inadequate, or, in the alternative, to enlarge the time to serve and file a brief.
Upon the papers filed in support of the motions and the papers filed in opposition thereto, it is
ORDERED that the appellant's motion is denied; and it is further,
ORDERED that the branch of the respondent's motion which is to dismiss the appeals from the orders dated June 19, 2015, as untimely taken, is held in abeyance and referred to the panel of Justices hearing the appeals for determination upon the argument or submission thereof; and it is further,
ORDERED that the branch of the respondent's motion which is to dismiss the appeals on the ground that the record is inadequate is denied on condition that on or before August 9, 2016, the appellant serve and file a supplemental record containing papers filed by the respondent in support of its motion for summary judgment, the papers filed by the appellant in support of the appellant's motion for renewal, including the order to show cause, and the respondent's papers filed in opposition to the motion for renewal; and it is further,
ORDERED that the branch of the respondent's motion which is to enlarge the time to serve and file a brief is granted, the respondent's time to serve and file a brief is enlarged until September 8, 2016, and the respondent's brief must be served and filed on or before that date.
