2015-10223 In the Matter of Regina Farage, petitioner, v Yvonne Lewis, etc., et al., respondents.
| DECISION & ORDER ON MOTION |
Proceeding pursuant to CPLR article 78, inter alia, in the nature of mandamus to compel certain Justices of the Supreme Court, Kings County, to take certain actions, and in the nature of prohibition to prohibit them from taking certain other actions. By decision and order on motion of this Court dated February 23, 2016, the motion for poor person relief was denied, and the petitioner was given 120 days within which to pay the filing fee, or the proceeding would be dismissed. The petitioner has not complied with that directive, and 120 days have passed.
Now, upon the Court's own motion, and upon the petitioner's failure to comply with the decision and order on motion of this Court dated February 3, 2016, it is
ORDERED that the proceeding is dismissed, without costs or disbursements.
DILLON, J.P., COHEN, BARROS and CONNOLLY, JJ., concur.
