Motion by the respondent to lift the stay imposed pursuant to CPLR 1015(a) on an appeal from an order of the Supreme Court, Kings County, dated October 9, 2015, effective upon the death of the deceased appellant, Elias Jaghab, Jr., and to enlarge the time to serve and file a brief.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion is dismissed without prejudice for renewal by an authorized representative of the estate of Elias Jaghab, Jr.
