Application pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to perfect an appeal and cross appeals from an order of the Supreme Court, Dutchess County, dated January 2, 2016.
Upon the papers filed in support of the application and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the application is granted; and it is further,
ORDERED that the defendant third-party plaintiff-appellant-respondent's time to perfect the appeal is enlarged until October 31, 2016, and the joint record or appendix on appeal (see 22 NYCRR 670.8[c][1]) and the appellant-respondent's brief must be served and filed on or before that date; and it is further,
ORDERED that the plaintiffs-respondents-appellants shall serve and file their answering brief, including their points of argument on the cross appeal, on or before December 15, 2016 (see 22 NYCRR 670.8[c][3]); and it is further,
ORDERED that Nationwide Dock & Door, Inc., Federal Express Corporation, and Gregory Konzal and Gregory Konzal, doing business as Garage Doors Unlimited, shall serve and file their respective answering briefs, including the points of argument on their cross appeals, on or before January 20, 2017 (see 22 NYCRR 670.8[c][3]); and it is further,
ORDERED that the defendant third-party plaintiff-appellant-respondent shall serve and file its reply brief on or before February 27, 2017; and it is further,
ORDERED that the plaintiffs-respondents-appellants and Nationwide Dock & Door, Inc., Federal Express Corporation, and Gregory Konzal and Gregory Konzal, doing business as Garage Doors Unlimited, shall serve and file their respective reply briefs on or before March 20, 2017.
