DECISION & ORDER ON MOTION

Motion by Jason M. Bernheimer, counsel assigned to prosecute appeals from two judgments of the County Court, Westchester County, rendered December 17, 2014, and April 7, 2015, respectively, to be relieved on the ground that the appellant has abandoned the appeals, by failing to respond to communications by assigned counsel. Cross motion by the respondent to dismiss the appeals as abandoned.

Upon the papers filed in support of the motion and the papers filed in relation thereto, and upon the papers filed in support of the cross motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the motion and the cross motion are granted, the appeals are dismissed (see 22 NYCRR 670.8[f]), and Jason M. Bernheimer is relieved of the assignment.
