DECISION & ORDER ON MOTION

Motion by the appellant on an appeal from an order of the Supreme Court, Suffolk County, dated July 10, 2014, to vacate so much of a decision and order on motion of this Court dated April 26, 2014, as directed the appellant to serve and file a supplemental appendix containing an errata sheet for the transcript of the trial in the above-entitled action or an affirmation that there are no changes to the transcript, or, in the alternative, to extend the time to comply with that provision of the decision and order on motion dated April 26, 2014.

Upon the papers filed in support of the motions and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is to extend the time to comply with the provision of the decision and order on motion dated April 26, 2014, that directed the appellant to serve and file a supplemental appendix containing an errata sheet for the transcript of the trial in the above-entitled action or an affirmation that there are no changes to the transcript is granted, and on or before August 10, 2016, the appellant shall either serve and file a supplemental appendix containing an errata sheet for the transcript of the trial in the above-entitled action or an affirmation that there are no changes to the transcript with the Clerk of this Court, after the appellant has properly settled the transcript of the trial, in accordance with CPLR 5525; and it is further,

ORDERED that no further enlargement of time to comply shall be granted; and it is further,

ORDERED that the motion is otherwise denied.
