Proceeding pursuant to Labor Law § 220 commenced in this Court on December 7, 2015. The respondent filed its answer on January 4, 2016. By order to show cause dated June 3, 2016, the parties were directed to show cause before this Court why an order should or should not be made and entered dismissing the above-entitled proceeding for failure to perfect in accordance with the rules of this Court.
Now, upon the order to show cause and the papers filed in response thereto, it is
ORDERED that the motion to dismiss the proceeding is granted, and the proceeding is dismissed, without costs or disbursements (see 22 NYCRR 670.18[c]).
