The People of the State of New York, Plaintiff, v George Scivolette, Defendant.

Application by defendant pursuant to CPL 450.15 and 460.15 for a certificate granting leave to appeal to this court from so much of an order of the Justice Court of the Town of Poughkeepsie, Dutchess County, entered March 4, 2016, as denied his CPL 440.10 motion to vacate the judgment, which has been referred to me for determination.

Upon the papers filed in support of the application and no papers having been filed in opposition thereto, it is
