Appellant having moved for "Relief from Fraud on and by The Court Deprivation of Fundamental Rights" on the appeals taken herein from orders and judgments of Supreme Court entered in the Office of the Clerk of the County of Monroe on June 29, 2013 (docket No. CA 14-00073), April 24, 2014 (docket No. CA 14-01251), July 24, 2009 (docket No. CA 14-01013), August 12, 2010 (docket No. CA 16-01014), August 17, 2010 (docket No. CA16-01015), January 8, 2014 (docket No. CA 16-01016), and December 16, 2015 (docket No. CA 16-01017), and for other relief, and respondent having cross-moved to dismiss the appeal taken from the order entered December 16, 2015, on the ground that appellant failed to perfect timely the appeal,
Now, upon reading and filing the affidavit of Kevin Patrick Brady sworn to May 31, 2016, the affirmation of Richard S. Mullen, Esq., dated July 1, 2016, and the notices of motion and cross motion with proof of service thereof, and due deliberation having been had thereon,
It is hereby ORDERED that appellant's motion is denied, and
It is further ORDERED that respondent's cross motion is granted and the appeal taken from the order entered December 16, 2015, is dismissed without further order unless the appeal is perfected on or before September 19, 2016.
