DECISION & ORDER ON MOTION

Motion by respondent on an appeal from a judgment of conviction of the District Court of Suffolk County, First District, rendered April 9, 2014, to strike the appellant's brief for failure to include certain required transcripts in the record on appeal, or for alternative relief. Cross motion by appellant for leave to proceed upon an abridged record.
Upon the papers filed in support of the motion and cross motion, it is
ORDERED that respondent's motion is granted and the appellant's brief is stricken; and it is further,
ORDERED that appellant's cross motion is denied; and it is further,
ORDERED, on the court's own motion, that appellant's time to perfect the appeal is enlarged to October 7, 2016; and it is further,
ORDERED that in the event the appeal is not perfected on or before October 7, 2016, the court, on its own motion, may dismiss the appeal, or respondent may move to dismiss the appeal on three days' notice.
