DECISION & ORDER ON MOTION

Motion by the appellant pro se on an appeal from a judgment of the Supreme Court, Queens County, entered July 11, 2013, for leave to reargue those branches of his prior motion which was to waive payment of the filing fee and for leave to file less than nine copies of the appellant's brief, which were determined by decision and order on motion of this Court dated December 17, 2015.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that on the Court's own motion, the appeal is dismissed, without costs or disbursements, for failure to timely perfect in accordance with the rules and prior order (see 22 NYCRR 670.8[e]) of this Court; and it is further,

ORDERED that the motion is denied as academic.
