Appellant having moved for an extension of time to perfect the appeal taken herein from an order and a judgment and order of the Supreme Court entered in the Office of the Clerk of the County of Oneida on July 23, 2015, and January 5, 2016,
Now, upon reading and filing the affirmation of Edward C. Cosgrove, Esq., dated July 12, 2016, and the notice of motion with proof of service thereof, and due deliberation having been had thereon,
It is hereby ORDERED that the motion is granted to the extent that the first ordering paragraph of the order of this Court entered May 23, 2016, is hereby amended by deleting the date July 19, 2016, and inserting in its place the date September 2, 2016, and
It is further ORDERED that the motion insofar as it seeks an extension of time to perfect appeal No. 2 is dismissed as premature (see 22 NYCRR 1000.13 [f]).
