2015-12112 Wells Fargo Bank, N.A., respondent, v Kashima Thompson, et al., appellants, et al., defendant. (Index No. 54896/13)
| DECISION & ORDER ON MOTION |
Appeal by Kashima Thompson and Stephanie Bivins from an order of the Supreme Court, Westchester County, dated September 24, 2015. By order to show cause dated June 7, 2016, the parties were directed to show cause before this Court why an order should or should not be made and entered dismissing the appeal in the above-entitled action on the ground that no appeal lies from an order entered upon the default of the appealing party.
Now, upon the order to show cause and the papers filed in response thereto, it is
ORDERED that the motion to dismiss the appeal is denied; and it is further,
ORDERED that on the Court's own motion, the appellant's time to perfect the appeal is enlarged until October 14, 2016, and the record or appendix on the appeal and the appellant's brief must be served and filed on or before that date.
ENG, P.J., ROMAN, DUFFY and BRATHWAITE NELSON, JJ., concur.
