Respondent Nazareth College of Rochester having moved and respondent Crosby-Brownlie, Inc. having moved cross-moved for an extension of time to file and serve briefs on the appeal taken herein from an order of the Supreme Court entered in the Office of the Clerk of the County of Genesee on December 10, 2015,

Now, upon reading and filing the affidavit of Tamsin J. Hager, Esq., sworn to August 4, 2016, the affirmation of Jennifer J. Phillips, Esq., dated August 8, 2016, and the notices of motion and cross motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that respondent Nazareth College of Rochester's motion is granted to the extent that the first ordering paragraph of the order of this Court entered June 14, 2016, is hereby amended by deleting the date August 12, 2016, and inserting in its place the date September 12, 2016, and

It is further ORDERED that the second order paragraph of the order of this Court entered June 14, 2016, is hereby amended by deleting the date August 29, 2016, and inserting in its place the date September 27, 2016, and

It is further ORDERED that respondent Crosby-Brownlie, Inc.'s cross motion is granted on the condition that the brief is filed and served on or before September 12, 2016, and the Clerk is directed to accept the brief for filing, and

It is further ORDERED that reply briefs to respondent Crosby-Brownlie, Inc.'s brief, if any, shall be filed and served on or before September 27, 2016.
