Appellant having moved for this Court to recuse itself from further actions on the appeal or, in the alternative, for an extension of time to perfect the appeal taken herein from an order of the Supreme Court entered in the Office of the Clerk of the County of Monroe on February 1, 2016, and for other relief,
Now, upon reading and filing the affidavit of David G. Harris sworn to July 20, 2016, the notice of motion with proof of service thereof, and the affidavit of Thomas S. D'Antonio, Esq., sworn to August 12, 2016, and due deliberation having been had thereon,
It is hereby ORDERED that the motion insofar as it seeks an extension of time to perfect the appeal is granted to the extent that the ordering paragraph of the order of this Court entered June 7, 2016, is hereby amended by deleting the date August 5, 2016, and inserting in its place the date September 9, 2016, and
It is further ORDERED that the motion is otherwise denied.
