The Attorney for the Children having moved for permission to file late notices of appeal and for an extension of time to file and serve a brief on the appeals taken herein from orders and a judgment of the Supreme Court entered in the Office of the Clerk of the County of Oneida on January 13, 2015, and June 3, 2015,

Now, upon reading and filing the affidavit of John G. Koslosky, Esq., sworn to July 5, 2016, and the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion insofar as it seeks an extension of time to file and serve a respondent's brief is granted to the extent that the first ordering paragraph of the

order of this Court entered June 6, 2016, is hereby amended by deleting the date July 6, 2016, and inserting in its place the date September 16, 2016, and

It is further ORDERED that the second ordering paragraph of the order of this Court entered June 6, 2016, is hereby amended by deleting the date July 21, 2016, and inserting in its place the date October 3, 2016, and

It is further ORDERED that the motion is dismissed insofar as it seeks to file late notices of appeal without prejudice (see CPLR 5513 (a).

Memorandum: The motion failed to include proof of service of the notices of appeal, if any, on behalf of the children, and proof of service of the orders appealed with notice of entry upon counsel for the children.
