It is Ordered that the motion of the tenant-appellant is granted on condition that tenant-appellant: (1) perfects her appeal by no later than the December 2016 term, the filing deadline for which is October 11, 2016; (2) pays the landlord the sum of $24,000 in rent arrears through January 2016 pursuant to the decision/order of the Civil Court, Bronx County (Alpert, J.) dated January 6, 2016, on or before September 9, 2016; and (3) pays the landlord accruing use and occupancy in the amount reserved in the most recent lease agreement on or before each subsequent rental due date, without prejudice. In the event of tenant-appellant's failure to comply with the foregoing condition, landlord-respondent may move, on five days' notice, for an order vacating the stay and dismissing the appeal.
