DECISION & ORDER ON

FOR REINSTATEMENT

Motion by Louis M. Pugliese for reinstatement to the Bar as an attorney and counselor-at-law. Mr. Pugliese was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the Second Judicial Department on May 28, 2003. By decision and order on application of this Court dated February 23, 2011, the Grievance Committee for the Tenth Judicial District was authorized to institute and prosecute a disciplinary proceeding against Mr. Pugliese based on a verified petition dated October 12, 2010, and the matter was referred to John D. Clarke, Esq., as Special Referee, to hear and report. By decision and order on motion of this Court dated October 7, 2011, Mr. Pugliese's motion, inter alia, to dismiss the disciplinary proceeding was denied. By opinion and order of this Court dated March 26, 2014, Mr. Pugliese was suspended from the practice of law for a period of two years, commencing April 25, 2014, based on two charges of professional misconduct. By decision and order on motion of this Court dated August 27, 2014, Mr. Pugliese's motion for leave to reargue the disciplinary proceeding against him was granted, and, upon reargument, the Court adhered to its prior determination.

Upon the papers filed in support of the motion and the papers filed in relation thereto, it is

ORDERED that the motion is held in abeyance and the matter is referred to the Committee on Character and Fitness to investigate and report on Louis M. Pugliese's character and general fitness to practice law, including but not limited to, whether he appreciates the wrongfulness of his misconduct.
