DECISION & ORDER ON MOTION

Appeal from a judgment of conviction of the District Court of Nassau County, First District, purportedly rendered February 18, 2016. The notice of appeal was filed on June 28, 2016. By decision and order on motion of this court dated August 4, 2016, the parties were directed to show cause before this court why the above-entitled appeal should or should not be dismissed as untimely and appellant had not sought leave to file a late notice of appeal (see CPL 460.10, 460.30).
Now, upon the order to show cause and the papers filed in opposition and in response thereto, it is
ORDERED that the motion to dismiss is denied; and it is further,
ORDERED, on the court's own motion, that the notice of appeal from the judgment of conviction purportedly rendered February 18, 2016 is treated as a valid notice of appeal from the judgment of conviction rendered June 24, 2016 (see CPL 460.10 [6]).
