DECISION & ORDER ON MOTION

Motion by 95 Utica Avenue, LLC, for leave to appeal to this Court from an order to show cause of the Supreme Court, Kings County, dated August 16, 2016, and to stay the sale of the subject premises, pending hearing and determination of the appeal from the order to show cause.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is granted, and the sale of the subject premises is stayed pending hearing and determination of the appeal or determination by the Supreme Court, Kings County, of the motion that was initiated by the order to show cause, whichever occurs first.
