| DECISION & ORDER ON MOTION |
Motion by the appellant for leave to serve and file a supplemental brief on an appeal from a judgment of the Supreme Court, Kings County, rendered January 8, 2013, raising an issue concerning People v John (27 NY3d 294), and to enlarge the time to serve and file a reply brief.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is granted; and it is further,
ORDERED that on or before October 7, 2016, the appellant may serve and file a supplemental brief raising an issue concerning People v John, the respondent's brief in response to the appellant's supplemental brief, if any, shall be served and filed on or before November 14, 2016, and the appellant's supplemental reply brief, if any, shall be served and filed on or before November 29, 2016; and it is further,
ORDERED that the appellant's time to serve and file a reply brief is enlarged until September 21, 2016, and the appellant's reply brief shall be served and filed on or before that date.
