DECISION & ORDER ON MOTION

Appeal by Rudolph Bisnauth from a judgment of the County Court, Suffolk County, rendered April 4, 2011. By order to show cause dated July 20, 2016, the parties were directed to show cause before this Court why an order should or should not be made and entered dismissing the appeal as abandoned.

Now, upon the order to show cause and no papers having been filed in response thereto, it is

ORDERED that the motion to dismiss the appeal is denied as academic in light of the order on application of this Court dated August 24, 2016, which granted the applicant's application to withdraw the appeal.
