An appeal having been taken herein from an order of Family Court, Onondaga County, entered in the Office of the Clerk of said Court on December 17, 2015, and counsel for respondent-appellant having moved for permission to withdraw appellant's brief and prior motion, for the assignment of new appellate counsel, and for other relief,
Now, upon reading and filing the affirmation of Philip Rothschild, Esq., dated July 27, 2016, and the notice of motion with proof of service thereof, and due deliberation having been had thereon,
It is hereby ORDERED that the motion is in all respects granted, and
It is further ORDERED that the record on appeal and respondent-appellant's brief are deemed withdrawn and the appeal is removed from the Court's calendar, and
It is further ORDERED that John A. Cirando, Esq., 101 South Salina Street, Suite 1010, Syracuse, New York 13202, is hereby substituted as counsel to conduct the appeal, and
It is further ORDERED that the Clerk of the Family Court, Onondaga County, is hereby directed to provide John A. Cirando, Esq., with copies of all papers and transcripts of stenographic, digitally recorded, or audiotaped minutes, if any, of the proceedings had and filed in said Clerk's Office upon which the appeal is based, and
It is further ORDERED that respondent-appellant file the original stipulated or settled record and ten briefs on the appeal, together with proof of service, on or before November 7, 2016, and in the event of failure to so perfect the appeal is hereby dismissed without further order.
