Petitioner-respondent having moved to dismiss the appeal taken herein from an order of the Family Court, Cayuga County, entered in the Office of the Clerk of said Court on May 6, 2016, on the ground that respondent-appellant has failed to perfect the appeal timely,
Now, upon reading and filing the affidavit of Samuel P. Giacona, Esq., sworn to August 11, 2016, and the notice of motion with proof of service thereof, and due deliberation having been had thereon,
It is hereby ORDERED that the amended notice of appeal filed May 26, 2016, shall be treated as valid as to the order of Family Court entered May 6, 2016, and
It is further ORDERED that the motion is granted and appeal is dismissed without costs.
