ORDERED that the decision and order on motion of this Court dated September 14, 2016, in the above-entitled matter, on an appeal and cross appeal from an order of the Supreme Court, Kings County, dated January 29, 2016, is amended by adding to the first paragraph thereof following the words "the appellant-respondent North Flats, LLC," the words "and the appellant-respondent Building Dev. Corp." and by adding to the third paragraph thereof, following the words "North Flats, LLC," the words "and Building Dev. Corp."
