Appeal by the defendant from a judgment of the Supreme Court, Queens County, rendered April 24, 2013. By decision and order of this Court dated December 30, 2015, the matter was remitted to the Supreme Court, Queens County, to afford the defendant an opportunity to move to vacate his plea and for a report on any such motion, and the appeal was held in abeyance in the interim. Stipulation by the parties to withdraw the appeal on the ground that the appeal has been rendered academic.
Upon the stipulation of the parties dated July 11, 2016, it is
ORDERED that the appeal is deemed withdrawn.
