DECISION & ORDER ON MOTION

Motion by the respondent to enlarge the record on an appeal from an order of the Supreme Court, Nassau County, entered March 18, 2016, to include the appellant's memorandum of law submitted in connection with the motion that was determined by the order entered March 18, 2016, to strike its memorandum of law from the record on appeal, and to enlarge the time to serve and file a brief.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the branch of the motion which is to strike the respondent's memorandum of law from the record on appeal is granted, and on or before October 11, 2016, the appellant shall remove pages 125 through 136 from, as well as delete references to those pages in the table of contents of the copies of the record filed with the Clerk of the Court; and it is further,

ORDERED that the branch of the motion which is to enlarge the respondent's time to serve and file a brief is granted, the respondent's time to serve and file a brief is enlarged until November 14, 2016, and the respondent's brief must be served and filed on or before that date; and it is further,

ORDERED that the motion is otherwise denied.
